Sex offenders fight for right to use Facebook

INDIANAPOLIS (AP) ? Registered sex offenders who have been banned from social networking websites are fighting back in the nation's courts, successfully challenging many of the restrictions as infringements on free speech and their right to participate in common online discussions.

The legal battles pit public outrage over sex crimes against cherished guarantees of individual freedom and the far-reaching communication changes brought by Facebook, LinkedIn and dozens of other sites.

"It's going to be really, really hard, I think, to write something that will achieve the state's purpose in protecting children online but not be restrictive enough to be unconstitutional," said Carolyn Atwell-Davis, director of legislative affairs at the Virginia-based National Center for Missing & Exploited Children.

Courts have long allowed states to place restrictions on convicted sex offenders who have completed their sentences, controlling where many of them live and work and requiring them to register with police. But the increasing use of social networks for everyday communication raises new, untested issues.

The bans generally forbid offenders to join social networks or chat rooms or use instant-messaging programs ? just a few of the online tools that civil liberties advocates say have become virtually indispensable to free speech.

After hearing challenges, federal judges in two states threw out laws or parts of laws that they deemed too stringent. In Nebraska, the decision allowed sex offenders to join social networks. And in Louisiana, a new law lets offenders use the Internet for shopping, reading news and exchanging email. A case filed against Indiana's law is under review.

Authorities insist the bans address a real problem: the need to protect children from pedophiles who prowl online hangouts visited by kids.

"It's hard to come up with an example of a sexual predator who doesn't use some form of social networking anymore," said Steve DeBrota, an assistant U.S. attorney in Indianapolis who prosecutes child sex crimes.

Ruthann Robson, a professor of constitutional law at the City University of New York, said the bans could eventually be taken up by the Supreme Court if the justices decide there's a constitutional question.

"If we think that the government can curtail sex offenders' rights without any connection to the actual crime, then it could become a blanket prohibition against anyone who is accused of a crime, no matter what the crime is," Robson said.

Supporters of the bans say they target repeat offenders such as a Maryland man charged with extorting a 16-year-old girl Indiana girl to perform sexual acts during video chats. He was free on bond when he was accused of doing the same thing to more underage girls.

Trevor J. Shea, 21, of Mechanicsville, Md., was sentenced to 33 years in federal prison in January after pleading guilty to seven counts of production of child pornography.

Xavier Von Erck, founder of Perverted Justice Inc., a group devoted to exposing online sexual predators, said it doesn't make sense for judges to let pedophiles troll the Web for more victims but revoke the voting rights of people convicted of lesser crimes. He called that "judicial hypocrisy."

The American Civil Liberties Union of Indiana, which is challenging Indiana's 2008 law, argues that it's unconstitutional to bar sex offenders who are no longer in prison or on probation from using basic online services.

"To broadly prohibit such a large group of persons from ever using these modern forms of communication is just something the First Amendment cannot tolerate," said Ken Falk, legal director of Indiana's ACLU chapter.

The case is scheduled for a court hearing Thursday. The main plaintiff, referred to in the suit only as "John Doe," was convicted on two counts of child exploitation in 2000 and released from prison in 2003, according to federal court documents.

The man cannot send questions to televised debates or comment on news stories on local websites because doing so requires a Facebook account, the ACLU contends. Neither can he communicate with his out-of-state family members using the social network or post his business profile on LinkedIn.

The plaintiff is also forbidden to supervise his teenage son's Internet use or investigate questionable friend requests sent to his child, the ACLU claims.

Prosecutors argue that social networking sites aren't the only forms of communication.

"The fact is that telephones still work. People including registered sex offenders may still congregate, discuss, debate and even demonstrate," Indiana Deputy Attorney General David Arthur wrote in a brief.

Television and radio are still widespread and offer numerous call-in shows. Newspapers still accept letters to the editor, he added.

The ACLU says precedent is on its side. The lawsuit cites a February ruling in Louisiana in which U.S. District Judge Brian Jackson found that the state's prohibition was too broad and "unreasonably restricts many ordinary activities that have become important to everyday life."

Louisiana lawmakers passed a new law this month that more narrowly defines what sites are prohibited. News and government sites, email services and online shopping are excluded from the new rules, as are photo-sharing and instant-messaging systems. The measure takes effect Aug. 1.

But courts continue to wrestle with the issue in Indiana and Nebraska, where a federal judge in 2009 blocked part of a law that included a social networking ban. A second legal challenge by an Omaha-area sex offender is set for trial in July.

"I think policymakers are struggling to come up with the right policy that makes sense," Atwell-Davis said. "There's no silver bullet."

Between holding up through the global economic crisis, and touting the world's most stable and safest banking system, True North has been attracting more U.S. companies to its Toronto Stock Exchange

The Canadian marketplace is growing, and the doors to the Toronto Stock Exchange (TSX) are wide open to U.S.-based companies ready to take on the capital market. To be sure, the U.S. IPO market is also open. Witness the successful public debuts of Yelp Inc (NYSE: YELP), Roundy's Inc (NYSE: RNDY) and Millennial Media (NYSE: MM).

But not every IPO hopeful has prospered. The Miami, Fla.,-based wireless products distributor Brightstar Corporation, and the Lenexa, Kan.,-based equities and options exchange operator Bats Global Markets did not have it so lucky and had to shelve their IPO plans. For whatever the reason: volatile markets, a glitch in the trading system, or just not being big enough, U.S. companies may have better luck at using the TSX as a stepping stone to access the capital market. Canada prides itself on the fact that it has managed to hold up through the global economic crisis. The country is also considered to have the world's most stable and safest banking system.

Some little-known facts: not one bank collapsed in Canada during the economic downturn, and 50 percent of Canadians own stocks in publicly-traded companies. As of December 31, there were 23 U.S.-based companies that went public on the TSX, which collectively raised $1.3 billion.

In total, there are 172 U.S. companies that are trading on the TSX and the TSX Venture Exchange including Atlantic Power (TSX: ATP), SXC Health Solutions Corp. (TSX: SXC), and Tahoe Resources Inc. (TSX: THO). U.S. companies can start to trade on the Canadian stock exchange by a reverse merger or through a special purpose acquisition corporation (SPAC).

Companies can also go through as a capital pool company (CPC), a program that launched in 1987 and is offered exclusively by the TSX Venture Exchange. The CPC program allows small to medium-sized companies to get public financing without having the characteristics of a traditional IPO candidate. The program also allows a newly-formed company that only has cash, meaning no commercial operations or assets, to carry out an IPO just so it can raise start-up capital and list its securities to trade on the TSX Venture Exchange as a CPC.

The Foreign Asset Investment Trust (FAIT), a publicly-traded Canadian income trust which is designed specifically for U.S. investments, is another gateway for American companies to trade on the Canadian stock market. Companies have a shorter timeline to access the IPO market. It can take up to six months from the time the company has its planning meeting to the day it lists on the TSX. Companies that are successful will have the flexibility to solely focus on sustainable distribution efforts, and growing the company through acquisitions.

However, the grass isn't always greener on the other side. The process of a cross-boarder IPO can get complex. While it may appear to be an easier process, becoming a public company in Canada has additional expenses and IPO hopefuls will need to make sure to have free distributable cash flow on hand. From listing fees, accounting, auditing, legal fees and commission for underwriters, going public on the TSX can cost a medium-sized company between $500,000 to over $1 million.

Falling stout bubbles explained

Irish mathematicians may have solved the mystery of why bubbles in stout beers such as Guinness sink: it may simply be down to the glass.

Simulations suggest an upward flow at the glass's centre and a downward flow at its edges in which the liquid carried the bubbles down with it.

But the reasons behind this flow pattern remained a mystery.

Now a study on the Arxiv server reports simulations and experiments showing the standard glass' shape is responsible.

Many stout beers contain nitrogen as well as the carbon dioxide that is present in all beers.

Because nitrogen is less likely to dissolve in liquid, that results in smaller and longer-lasting bubbles.

But it is the sinking bubble that has confounded physicists and mathematicians alike for decades.

Like many such "fluid dynamics" problems, getting to the heart of the matter is no easy task; only recently was it proved they actually sink rather than being the result of an optical illusion.

Now the University of Limerick's William Lee, Eugene Benilov and Cathal Cummins have discovered the simple answer to the problem - and a test that can be carried out by consumers as well.

The team has been generally interested in the formation of bubbles in liquids.

"One of the things we found was it's actually very easy to see bubbles forming in stout beer rather than in, say, champagne where the bubble formation process is much more violent," Dr Lee told BBC News.

But as has happened to a generation of like-minded scientists before them, the question of falling bubbles became their focus.

The team had the idea - borne out by calculations carried out by Mr Cummins - that the relative density of bubbles and the surrounding liquid could be behind the phenomenon.

"If you imagine your pint is full of bubbles, then the bubbles will start to rise," Dr Lee said.

But the bubbles in a standard pint glass find themselves in a different environment as they rise straight up.

"Because of the sloping wall of the pint, the bubbles are moving away from the wall, which means you're getting a much denser region next to the wall," Dr Lee explained.

"That is going to sink under its own gravity, because it's less buoyant, and that sinking fluid will pull the bubbles down."

The bubbles, that is, are "trying" to rise, but the circulation that creates drives fluid down at the wall of the glass.

"You'll see sinking bubbles not because the bubbles themselves are sinking, but because the fluid is and it's pulling them down with it."

The same flow pattern occurs with other beers such as lagers, but the larger bubbles of carbon dioxide are less subject to that drag.

Mr Cummins carried out calculations using a simulated pint and "anti-pint" - that is, the upside-down version of a pint glass - showing the effect at work; in the anti-pint, the bubbles rise as expected.

For those interested in experimenting in the pub, the effect can be best seen if a pint of stout is served in a straight-sided, cylindrical glass (not quite filled up).

If the glass is tilted at an angle while the pint settles, the side in the direction of the tilt represents the normal situation of a pint glass, while the opposite side is the "anti-pint" - and bubbles can be seen to both rise and fall in the same glass.

Florida selected as top seed in baseball tourney

NEW YORK (AP) ? Florida heads into the NCAA tournament as college baseball's top team.

The Gators appreciate the honor, but they're interested only in finishing No. 1 at the College World Series.

"I think that we have a good team," coach Kevin O'Sullivan said. "I think that we had a good year. I'd agree with everybody that I don't think we have played our best yet, which is encouraging."

Florida (42-18) was selected Monday as the top seed for the 64-team tournament and will host one of 16 four-team, double-elimination regionals that begin Friday.

"That was a very close vote," said Kyle Kallander, chairman of the Division I baseball committee. "The committee really discussed at length who deserved to be that No. 1 overall. There were several deserving teams."

The other national seeds, in order, are: UCLA, Florida State, Baylor, Oregon, North Carolina, LSU and two-time defending College World Series champion South Carolina.

"We had four teams that were in serious consideration for that last top national seed, that No. 8 seed," Kallander said. "It was very competitive in the evaluation process."

Kallander said the Gators' overall body of work ? including a 21-10 record against top 25 teams ? put them in front of the field.

History has not been kind to the No. 1 overall seeds, though. Only once has a top seed gone on to win the College World Series: Miami in 1999, the first year the NCAA went to its current tournament format.

"Obviously, this is a great time of the year for everybody," said O'Sullivan, whose team opens against Mid-Eastern Athletic Conference champion Bethune-Cookman (34-25). "We're excited to be in it. We're excited to be home."

The Gamecocks (40-17) are trying to join the 1970-74 Southern California squads as the only teams to win three or more consecutive national titles. South Carolina opens against Manhattan (33-25), the Metro Atlantic Athletic Conference tournament champion.

Florida and South Carolina are among a tournament field-leading eight Southeastern Conference teams, including Arkansas, Kentucky, LSU, Mississippi, Mississippi State and Vanderbilt.

The Atlantic Coast Conference is second with seven teams: Clemson, Florida State, Georgia Tech, Miami, North Carolina, North Carolina State and Virginia.

The 16 regional winners move on to the best-of-three super regionals. Those eight winners advance to the College World Series, which begins June 15 in Omaha, Neb., at TD Ameritrade Park Omaha.

Miami (36-21) is in the tournament for the 40th straight year, extending its own record, while Florida State is making its 35th consecutive appearance. Dayton (31-28) and Samford (39-21) are making their tournament debuts, while Valparaiso (35-23) will play in a regional for the first time since 1968.

"I don't think our guys will be intimidated at all," said Valparaiso coach Tracy Woodson, a former major leaguer. "We've already played some great teams on our schedule this year."

Among those not in this year are Texas (30-22), which last missed out in 1998, and Utah Valley (47-12), which led Division I in wins but had a low RPI. Kallander said both were among 12 schools considered for the last couple of spots.

Utah Valley plays in the Great West Conference, which doesn't receive an automatic berth to the NCAA tournament. The Wolverines won 40 of their last 41 games, and 45 of their last 49.

"We've done everything we can to control our destiny," coach Eric Madsen said after Utah Valley won its third straight Great West tournament. "Forty out of 41, that's incredible."

Kallander, commissioner of the Big South Conference, said the lack of quality non-conference opponents was a key factor in the Wolverines being left out.

"They did very well against that schedule, so what you've got to do is go out in your non-conference schedule and schedule stronger, and of course, you have to have some success against that schedule," Kallander said. "They did have a couple of good wins, no doubt, and scheduled a few very good teams in the schedule, but it wasn't quite enough for the committee."

Two teams with losing records made the field of 64 ? Creighton (26-28) and Sacred Heart (25-30) ? by winning their conference tournaments.

FEU student is lone Filipino finalist in Google Science Fair 2012

Mark Borris Aldonza, a 17-year-old biology student from the Far Eastern University, is the country?s lone representative to the pool of regional finalists competing in the Google Science Fair 2012.

Aldonza is one of the 10 finalists out of hundreds in Asia under 17-18 year-old category and one of the 90 regional finalists out of the thousands who joined the 2012 Google Science Fair, a global online science competition for teenagers launched by the search giant last year.

He received an official acceptance letter from Google stating also that he will get a Chromebook to be shipped by June.

His research, "Novel Catalytic Effects and Molecular Screening of Condensed Tannins (Proanthocyanidins) Treatment on Hardwood Charcoals for Burning Length Longevity, EMF Radiation Shielding and in Decreasing Five Greenhouse Gas Emissions," showed that the highest concentrations of condensed tannins (CTs) gave the highest significance in prolonging the burning length of hardwood charcoals, as an electromagnetic field radiation (EMF) radiation shielding material and in decreasing five greenhouse gas emissions.

In his research, he cited that "charcoal has definitely the potential to alleviate poverty, generate income and enhance livelihoods." He added that "by developing charcoals like what I've done in this research, there'll be more options for fuel use."

"Also, the contribution of charcoals to global warming will definitely be lessen. This research opens a wide scope of well-developed contributions for the potentials of hardwood charcoals in general."

Launched in 2011, Google Science Fair drew more than 7,000 entries last year from inquiring young minds located in 91 countries; the fair has three age categories, for teens from 13 to 18.

Thirteen of the 90 finalists have also been nominated for the Scientific American Science in Action award, the winner of which will be announced on June 6 along with 15 finalists.

These top 15 and the Science in Action winner will be flown out to Google?s headquarters in California in July for the celebratory finalist event and for the last round of judging, which will be conducted by a panel of renowned scientists and innovators.

The Grand Prize winner for this year?s search will receive a National Geographic expedition, a $50,000 scholarship grant from Google, a personal LEGO color mosaic, and a chance for an internship either at Google, Lego, or CERN.

NHL.com reports: Hall of Famer Scotty Bowman was awarded the Order of Canada, the highest honor that can be bestowed upon a Canadian other than the Queen's Order of Merit, on Friday.

"It's certainly different from my Stanley Cup rings, and I look forward to wearing it on special occasions," Bowman told reporters after the ceremony at Ottawa's Rideau Hall in which he received the red-and-white medallion from Governor General David Johnston.

Bowman is the winningest coach in NHL history, winning nine Stanley Cups. He currently serves as a senior adviser of operations with the Blackhawks under general manager Stan Bowman, his son.

Newtown parish responds to video vilifying ministry to lesbian and gay

After last Sunday?s homily there has been some interest in the thoughts I expressed.? Far from judging and vilifying lesbians and gays, as we heard from Michael Voris in his video about the Newtown parish Friday night Mass, I suggested that hearing the stories of lesbian and gay Catholics and how that had influenced my reading in order to better pastorally care for all Catholics might offer a new way of seeing lesbian and gay Catholics as gift rather than ?the other? for whom we might feel sorry.

What I learned from hearing these stories was that lesbian and gay Catholics are like all people trying to live their faith ? they are searching for meaning and joy and authenticity in and through the Catholic community and the spiritual wisdom of the bible and church tradition. Catholics expect to find guidance and encouragement, as well as challenge, but? lesbian and gay Catholics find all too often that they are asked to deny their sexuality or, at best, to be invisible.

Theologians and spiritual writers are beginning to write from the perspective of the world in which we live and the life stories of lesbian and gay Catholics. If sexuality is a gift from God and if psychology and science are correct in finding that homosexuality is God-given, that is not chosen, then homosexuality must also be a gift from God.? What might this gift be?? Those doing theology with the insight of the stories of lesbian and gay Catholics and modern science suggest such areas as intimacy, friendship, faithful love and personal growth might be a gift to the church and indeed the world.?

Where traditional sexual ethics has dominated church teaching about heterosexual relationships and marriage; homosexuals have had to find the meaning for themselves of their God-given attraction and have made some astoundingly good gospel-based spiritual discoveries.? While heterosexual relationships are struggling in the current climate of distrust of church teaching; homosexual relationships, lived according to gospel principles of love, seem to be finding a beautiful expression.

But what of the scripture passages that seem so damning of homosexuality? Through scripture scholarship which emphasizes the meaning of the text in context, it seems that all the texts referring to homosexuality, and there are not many ? indeed, none in the gospel, all refer to abusive sexual relationships.? In times when people did not identify as gay, as they do today, it is reasonable to infer that the texts referring to homosexuality refer to people being used and abused.? Scriptural texts do encourage intimate and caring relationships and these can often be found among lesbian and gay couples.

I don?t pretend we have found a path forward yet but there are many within the church exploring these ideas.? What we try to do here at St Joseph?s Newtown is to support, and walk with, lesbian and gay Catholics as they try to faithfully live their faith authentically.

Including the outsider is a common theme here at Newtown parish and so it is not so surprising that we might explore such a ministry.? Let?s hope the likes of Michael Voris, and his Opus Dei money, don?t destroy this emerging gift for the church.
